In Oregon, if a decedent passes away without a will, their estate normally goes to probate court to be distributed among successors. However, the grieving family can avoid probate for certain items, such as boats, as long as they value less than $75,000. Title transfers normally move to surviving spouses and blood relatives first, but if relatives are not available, other successors may file an affidavit of inheritance for the decedent’s boat, as governed under Oregon statute ORS 830.755.
How to Write

Step 2 – Enter the following into the form:
- Header – Enter Superior Court (See List)
- Name of Decedent
- Date of Birth
- Case Number
- Check the three (3) boxes depending on your situation
- Date and Sign
- Verification – On the last page you will be required to verify that everything you have stated is true and accurate
- Boat title
Step 3 – Bring a certified copy of the death certificate and file the form with the proper clerk or courthouse.
