If a loved one dies in Mississippi and leaves no last will or testament, then loved ones may file an affidavit of heirship (vehicle only) to claim the decedent’s motor vehicles. While Mississippi law does not specifically cover affidavits of heirship involving vehicle title transfers to avoid probate court, these documents are respected as legal by title-holding companies, such as vehicle insurance companies. Generally, however, insurance companies in Mississippi will not accept affidavits of heirship (vehicle only) until several years – in some cases, 10 years or more – after the decedent passes, proving there are no other claims to the estate.
